Kubota – 50 Years of Excavators – Conditions of Entry

1. Information on how to enter this promotion (Promotion) and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry.
2. The Promoters are Kubota Australia Pty Ltd ABN 72 005 300 621, 25-29 Permas Way, Truganina, VIC, 3029 and Kubota New Zealand Ltd NZBN 9429047388000, 433 Rangitikei Street, Cloverlea, Palmerston North, 4412.
3. Entry is open to Australian and New Zealand Residents aged 18 years and over. By entering you confirm that you are over 18 years of age. Promoters will not be responsible for misinformation given in regard to age.
4. Promotion commences 1st April, 2024 at 12.00pm AEST and closes 23.59 AEST on 30th September, 2024 (Promotional period). Employees, Promoter Kubota Australia/New Zealand dealers and agencies associated with this promotion and their immediate family” are ineligible to enter. “Immediate family” means spouse, defacto spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent). Whether or not they live in the same household as the employee, Promoters or employees of Kubota Australia/New Zealand and the authorised Dealers. (Fleet and corporate purchases are not eligible for the promotion.)
5. To be eligible to enter, the customer must purchase of a NEW Kubota Excavator and pay for the purchase in full from the 1 April, 2024 to 30 September, 2024 to receive an automatic entry into the prize draw.
6. This promotion is eligible for multiple entries (one transaction equals on entry). Subject to entry requirement as indicated below in point 7.

8. There are 3 prizes to be given away. 1st prize is a Toyota Hilux GR Sport including delivery costs, 12months registration and on road costs. (Colour may vary depending on winners Country) valued at $79,600.00 AUD. 2nd prize is a trip for 4 to the 2024 Gold Coast Supercars (25th-27th October, 2024), including return economy flights to Coolangatta from the winner’s nearest capital city, 4 nights twin share accommodation in a 4 star hotel including return private car transfers from Coolangatta airport to hotel. Plus 4 Hospitality entry passes to the Gold Coast 500 valued up to $18,000.00 AUD. In the event the prize/s are not available due to the cancellation of the event or travel restrictions, it will be rebooked for a future event to the same value. 3rd prize is Pizza’s for a Year via Pizza Hut (3 Classic pizzas and sides every week) valued at $2026.00 AUD. 9. The Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as prizes.
10. Competition winners will be determined via random draw. The prize draw will take place on 1st October, 2024 at Kubota Australia, 25-29 Permas Way, Truganina VIC, 3029 at 12 noon AEST. The winners will be notified by email and phone following the draw (within three (3) working days) and winners will have their names announced on the Promoters website www.kubota.com.au and www.kubota.co.nz from the 5th October, 2024.
11. This is a game of chance. Skill plays no part in determining the winner and selected at random.
12. The Promoter will conduct a further draw, at the same time and place as the original draw as is necessary on 11th October, 2024 in order to distribute the 2 prize (Gold Coast Supercars) if it remains unclaimed by that date subject to any relevant legislation. If such a draw is required, the winner will be notified via email, phone and winner will have their name announced on the Promoters website www.kubota.com.au and www.kubota.co.nz from 12th October 2024. For any of the other prizes the Promoter will conduct further draws, at the same time and place as the original draw as is necessary on the 10th January, 2025 if any prizes remain unclaimed by that date subject to any relevant legislation. If such a draw is required, the winners will be notified via email, phone and winner/s will have their name announced on the Promoters website www.kubota.com.au and www.kubota.co.nz from 12th January, 2025.
13. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) for any personal injury suffered or sustained in connection with the prize except for any liability, which cannot be excluded by law. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including without limitation technical malfunctions or failures. Tax implications may arise from the receipt or use of a prize. Independent financial advice should be sought. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
14. The prize(s) cannot be exchanged for any other prize(s) or cash.

If for any reason this promotion is not capable of running as planned for example; because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion subject to any written directions under applicable legislation.
